1. Who is responsible for your data

The controller for this website within the meaning of the General Data Protection Regulation (GDPR) is:

This policy covers the website nxauto.be in all its language versions. It does not cover other websites we link to, including the websites of dealerships we work with and the platform login at content.modix.net.

2. What we do not do

We deliberately do not track visits to this site, beyond the server logs described in section 4. You will find no Facebook, Instagram, X/Twitter or comparable buttons here, and no tracking pixels.

This website sets no cookies and stores nothing in your browser. Fonts, images and videos are served from our own server, so opening a page does not cause your browser to contact any other company. Client areas which require a login use functional cookies necessary for security and operation; those are not part of this website.

3. The contact form

When you use the contact form we process the name you give, your dealership name, your email address, your telephone number, the content of your message, and which language version of the site you wrote from.

Is it required? No statutory or contractual obligation requires you to give us any of it. Your name and email address are needed for us to reply; the dealership name, telephone number and message are optional. The only consequence of not providing them is that we cannot answer you, or can answer only in general terms.

What happens to it. The form does not store anything on this website. No submission is written to the website's database and nothing is kept in your browser. The form composes an email and sends it to the mailbox that handles your language: enquiries from the Dutch and French versions go to be@nx-it.com, enquiries from the German and English versions go to helpdesk@nx-it.com. From that point the message exists only as an email in our mailbox.

How long we keep it. Where an enquiry does not lead to a business relationship, we delete the correspondence after two years. Where it does, the correspondence becomes part of the business records and is kept for the statutory retention periods described in section 7.

4. Server log files

Each time a page is requested, the web server records technical information automatically. These logs contain the IP address of the visitor, the type of browser used, and which pages of the site were called up.

These logs are overwritten automatically after 14 days. They are not used to identify individual visitors.

5. Customer and invoicing data

Where you become a customer, we store and process the data necessary to provide the service and to invoice it.

Suppliers involved in delivering a service to you — a domain registry, for example — receive only the data they need for that purpose, and only under a data processing agreement pursuant to Article 28 GDPR or, where they act as independent controllers, on their own legal basis. We do not pass customer data to unrelated third parties unless you expressly ask us to, or unless we are legally obliged to.

6. Who receives your data, and where it is processed

We do not sell personal data and we do not share it with other services or entities, except as necessary for our own accounting and to meet legal requirements.

This website and the mailboxes that receive enquiries run on servers owned and operated by NX-IT UG in Germany. No external hosting company, no external mail provider and no analytics service is involved. Your data therefore does not leave NX-IT UG, except where we are legally obliged to disclose it or where you ask us to pass it on.

Transfers outside the EU. All processing takes place on our own servers in Germany. We do not transfer personal data to countries outside the European Union or the European Economic Area.

Where we rely on Article 6(1)(f) GDPR, the interests concerned are answering business enquiries sent to us, and keeping this website available, stable and protected against misuse.

We have weighed those interests against your rights and freedoms. The data involved is limited to what you chose to send us or what the server records automatically, it is not used to build a profile, it is not combined with data from other sources, and it is not used for advertising. You may object to this processing at any time on grounds relating to your particular situation — see section 9.

Under the GDPR you have the right to:

• Access — obtain confirmation of whether we process your data and receive a copy of it (Article 15)
• Rectification — have inaccurate data corrected and incomplete data completed (Article 16)
• Erasure — have your data deleted where one of the grounds in Article 17 applies
• Restriction — require us to stop using your data while a dispute about it is resolved (Article 18)
• Data portability — receive the data you gave us in a structured, commonly used, machine-readable format, and have it sent to another controller (Article 20)
• Objection — object at any time, on grounds relating to your particular situation, to processing based on our legitimate interests (Article 21)

To exercise any of these, write to info@nx-it.com. We will respond within one month of receiving your request. Where a request is complex we may extend that by a further two months and will tell you within the first month if we do. Exercising these rights is free of charge.

10. Complaining to a supervisory authority

If you believe we are handling your data unlawfully, you may lodge a complaint with a data protection supervisory authority. You can complain to the authority in the country where you live or work, or where you believe the problem occurred.
